Nonpublic personal information means personally identifiable information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. Hereafter, we will use the term “information” to mean nonpublic personal information as defined in this section.
An affiliate is a company we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control.
A nonaffiliated third party is a person we do not employ or a company that is not an affiliate of ours. This is also known as nonaffiliated third party, or simply, an “other party.”
THE INFORMATION WE COLLECT
We collect information about you from the following sources:
- Information we receive from you on applications or other forms, such as your name, address, social security number, assets, and income,
- Information about your transactions with us, our affiliates or others, such as your account balance and payment history,
- Information we receive from a consumer reporting agency such as your creditworthiness and credit history,
- Information we receive about you as a result of verifying customer information.
CONFIDENTIALITY AND SECURITY MEASURES
We also take steps to safeguard your information. We restrict access to information about you to those employees who need to know that information to provide products or services to meet your needs. We also maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information.
YOUR INFORMATION AND OTHER PARTIES
We will not disclose information about you to anyone except as disclosed in this policy or as permitted by law. We do not sell information about you to nonaffiliated third parties.
We may disclose all of the information we collect, as described above, to companies that perform marketing services on our behalf, such as service providers that provide marketing assistance or direct sales companies.
We may also enter into joint marketing agreements with other financial institutions, such as financial service or insurance providers, to make available to you a greater range of financial products and services than we alone can offer. We may disclose to such joint marketers all of the information we collect, as described above, as needed in order to jointly market financial services.
We carefully choose such service providers and joint marketers and require them to comply with certain confidentiality standards and prohibit them from disclosing or using information about you solely for their own purposes.
We are also permitted by law to disclose information about you to nonaffiliated third parties in certain other circumstances. For example, we may disclose information about you to such third parties to assist us in servicing your loan or account with us, to process and service transactions you request or authorize, to protect potential fraud or unauthorized transactions, in response to judicial process, and to consumer reporting agencies.
INFORMATION ABOUT FORMER CUSTOMERS
We do not disclose information about former customers, except as disclosed in this policy or as permitted by law.
NOTICE OF NEGATIVE INFORMATION
Federal Law requires us to provide the following notice to customers before any “negative information” may be furnished to a nationwide consumer reporting agency. “Negative Information” includes information concerning delinquencies, overdrafts or any form of default. This notice does not mean that we will be reporting such information about you, only that we may report such information about customers that have not done what they are required to do under our agreement.
After providing this notice, additional negative information may be submitted without providing another notice.
We may report information about your account to credit bureaus. Late payments, missed payments or other defaults on your account may be reflected in your credit report.
